Terms of Service

Please read these Terms of Service carefully before using the VoiceCallAssistant platform. By accessing or using the service, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account or using any VoiceCallAssistant service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you may not use the service. These terms apply to all users including businesses, their employees, and any third parties who interact with the platform.

2. Description of Service

VoiceCallAssistant provides AI-powered call answering, lead screening, appointment scheduling, and related receptionist services for businesses ("Service"). The Service is provided on a subscription basis according to your selected plan.

3. Account Registration

You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at security@voicecallassistant.com if you suspect unauthorized access.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Harass, threaten, or deceive callers or third parties.
  • Transmit spam, unsolicited communications, or malware.
  • Attempt to reverse-engineer or circumvent security measures.
  • Resell or sublicense the Service without written permission.
  • Use the Service in a manner that disrupts or damages our infrastructure.

5. Subscription and Payment

Subscriptions are billed monthly or annually in advance. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Overages beyond your plan limits are billed at the applicable per-unit rate.

If payment fails, we may suspend your account after a 7-day grace period. Accounts suspended for non-payment for more than 30 days may be permanently deleted.

6. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. After cancellation, your data will be retained for 30 days and then permanently deleted unless you request an export.

7. Intellectual Property

VoiceCallAssistant and its licensors own all intellectual property rights in the Service, including software, trademarks, and documentation. You retain ownership of your data. By using the Service, you grant VoiceCallAssistant a limited license to process your data solely to provide the Service.

8. Confidentiality and Data

Both parties agree to keep the other's confidential information secure. VoiceCallAssistant will process your data in accordance with our Privacy Policy. For healthcare customers, we will execute a Business Associate Agreement (BAA) upon request.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEYREYNA'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL HEYREYNA BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless VoiceCallAssistant, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the Service or violation of these Terms.

12. Termination

Either party may terminate these Terms with 30 days' written notice. We may terminate immediately if you materially breach these Terms or engage in conduct that could harm VoiceCallAssistant or other users. Upon termination, your access to the Service will cease.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in San Francisco County, California.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email at least 30 days in advance. Continued use of the Service after the effective date constitutes acceptance of the revised terms.
